Terms of Service
1. Acceptance of Terms
By downloading, installing, or using BEHNARO ("the App", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use BEHNARO. These Terms constitute a legally binding agreement between you and Dominik Boryczko ("BEHNARO", "we", "us").
2. Description of Service
BEHNARO is a mobile platform that connects students seeking coaching with coaches offering their services. The platform enables booking sessions, purchasing courses, accessing AI-generated training plans, and participating in a social feed related to health and development.
3. Eligibility
- You must be at least 16 years old to use BEHNARO.
- If you are between 16 and 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.
- You must provide accurate and complete information when creating an account.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use at dboryczko@gmail.com. We reserve the right to terminate accounts that violate these Terms.
5. Coach Responsibilities
Coaches who list services on BEHNARO agree to:
- Provide accurate information about their qualifications, certifications, and experience.
- Honour bookings confirmed through the platform.
- Maintain appropriate professional standards and relevant insurance where applicable.
- Not engage in discriminatory practices based on race, gender, religion, nationality, or any other protected characteristic.
- Comply with all applicable local laws governing their coaching services.
6. Student Responsibilities
- Respect agreed booking times; provide reasonable notice (minimum 24 hours) for cancellations.
- Treat coaches professionally and respectfully.
- Consult a qualified medical professional before beginning any new physical training programme.
7. Payments and Fees
Payments are processed by Stripe. By making a purchase, you agree to Stripe's terms of service. BEHNARO may retain a platform fee on transactions between coaches and students. Fees are displayed clearly before purchase confirmation. Subscriptions renew automatically unless cancelled at least 24 hours before the renewal date.
8. Refund Policy
- Sessions: Full refund if cancelled at least 24 hours before the session. No refund for late cancellations or no-shows, unless the coach cancels.
- Courses: Full refund within 14 days of purchase if less than 30% of the course content has been accessed.
- Premium subscriptions: Refunds at our discretion; contact dboryczko@gmail.com.
9. AI-Generated Content
BEHNARO uses artificial intelligence to generate training plans. AI-generated content is provided for informational purposes only and does not constitute medical, nutritional, or professional fitness advice. Always consult a qualified professional before starting a new training regimen. We are not liable for injury or adverse outcomes resulting from following AI-generated plans.
10. User Content
You retain ownership of content you post (photos, videos, text). By posting, you grant BEHNARO a non-exclusive, royalty-free, worldwide licence to display and distribute your content within the platform. You are solely responsible for ensuring your content does not infringe third-party rights or violate applicable law. We reserve the right to remove content that violates these Terms.
11. Prohibited Conduct
You agree not to:
- Impersonate another person or misrepresent your qualifications.
- Post spam, offensive, hateful, or illegal content.
- Use BEHNARO to solicit users to transact outside the platform to avoid fees.
- Attempt to reverse-engineer, hack, or disrupt the platform.
- Scrape data or use automated bots without prior written consent.
12. Intellectual Property
All BEHNARO trademarks, logos, software, and content (excluding user-generated content) are the property of Dominik Boryczko. You may not copy, reproduce, modify, or distribute them without prior written permission.
13. Limitation of Liability
To the fullest extent permitted by law, BEHNARO shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid to BEHNARO in the 12 months preceding the claim.
14. Indemnification
You agree to indemnify and hold harmless BEHNARO and Dominik Boryczko from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.
15. Termination
We may suspend or terminate your account at our discretion if you violate these Terms. You may delete your account at any time from the app settings. Upon termination, your right to use the Service ceases immediately.
16. Changes to Terms
We may update these Terms from time to time. We will notify you via email or in-app notification at least 14 days before changes take effect. Continued use after that date constitutes acceptance of the updated Terms.
17. Governing Law
These Terms are governed by the laws of Poland. Any disputes shall be resolved in the courts of Warsaw, Poland, unless mandatory consumer protection laws in your country of residence require otherwise.
